The Prosecution of BiH requested the prohibiting measures in order to prevent eventual attempts to influence witnesses, including a few protected witnesses, and ensure their uninterrupted testimony.
The Defence teams neither objected to the extension of prohibiting measures nor ordering of those measures against indictee Kaminic.
“Due to procedural reasons, we are not objecting to the Prosecution’s proposal. However, I do not see the reason for requesting those measures now that the witnesses have already given their statements, knowing that they were not requested three months ago, when the investigation was ongoing,” said Senad Dupovac, Defence attorney of the fifth indictee.
Indictees Enes Curic, Ibrahim Demirovic, Samir Kreso, Habib Copelj and Mehmed Kaminic are charged with having participated in the unlawful deprivation of liberty and detention of Croat civilians in the broader area of Mostar municipality from late June to the beginning of December 1993.
The indictment, which the Court of BiH confirmed on October 14, 2014, alleges that civilians were subjected to severe physical and mental mistreatment and held in inhumane conditions.
The State Prosecution alleges that Curic was member of the 49th Mountain Brigade of the Army of Bosnia and Herzegovina, ABiH, and Manager of a detention facility in the school building and other detention facilities in Potoci, Demirovic was Commander of the 47th Mountain Brigade of ABiH, Kreso was Chief of the Medical Unit of a military unit with the Mountain Brigade, which was active in the Bijelo Polje area, while Copelj and Kaminic were members of ABiH.
As per a proposal by the State Prosecution, at the beginning of September the Court of BiH ordered prohibiting measures against four indictees. Such measures were not requested for the fifth indictee – Kaminic.
The Court will render a decision concerning the Prosecution’s proposal at a later stage.
