The Appellate Chamber rendered a decision to hold a retrial after having considered the appeals filed by the Prosecution and Defence. The appeals were filed against a first instance verdict, under which Alija Osmic was sentenced to 11 years in prison.

The Appellate Chamber decided to revoke the first instance verdict, because, as indicated by the Court of Bosnia and Herzegovina, “the indictment was overstepped and incomprehensive”, and order a retrial.

Under the first instance verdict of March 4, 2011, Osmic was pronounced guilty of war crimes against prisoners of war, who were detained in various buildings in Bugojno.

The first instance Chamber determined that the indictee, former member of military police with the 307th Motorised Brigade of ABiH, committed murder and caused physical injuries of detained members of the Croatian Defence Council, HVO in the period from July 1993 to March 1994.

Osmic was taken into custody following the pronouncement of the verdict. M.T.
