Klickovic et al: Case Separation Motion Rejected

The Trial Chamber, sitting in the case of crimes committed in Bosanska Krupa, rejected the motion filed by the Defence of Jovan Ostojic asking for a separation of his case from the case of Klickovic et al currently before the Court of Bosnia and Herzegovina in Sarajevo.
The Chamber determined that the separation of the cases would “make the situation even more complicated” at this stage.
The Prosecution charges Ostojic, under the same indictment as Klickovic and Mladen Drljaca, with crimes against humanity committed in the Bosanska Krupa area in the course of 1992.
The Prosecution did not object to the case separation motion filed by Ostojic’s Defence. The motion claimed that “his trial would be shortened by several months” if the cases were separated.
Klickovic’s Defence “in principle” did not have any objection, while Drljaca’s Defence declined to respond to the case separation motion.
The beginning of evidence presentation by Klickovic’s Defence has been postponed because the indictee is not ready to testify, as the Trial Chamber has not allowed him to comment during his testimony on the evidence presented so far.
“There is no point in talking about the joint criminal enterprise or commenting or analyzing the trial during the course of your testimony. You can speak about these things in your closing arguments. The Court will not deprive you of your rights,” Zdravko Bozic explained.
The examination of Klickovic, who will testify as a Defence witness, is due to take place at the next hearing, scheduled for Tuesday, April. 7.
