Pincic: Psychological pressure

The indictee's daughter refuses to testify as Prosecution witness, claiming that she thinks that she is not capable of doing it.

Danijela Pincic, who was supposed to testify as an additional Prosecution witness against her father Zrinko, started crying in the courtroom, saying that she thought she was not capable of doing it, because the testimony had a “psychological influence” on her.

After having been informed by Trial Chamber Chairwoman Minka Kreho that, by law, a person was not obliged to testify if he/she was the indictee’s close relative, Danijela Pincic decided to leave the courtroom. 
 
The State Prosecution charges Zrinko Pincic, as member of the Croatian Defence Council, HVO, with having come, “armed and dressed in military uniform” to Donje selo, in Konjic municipality, and forced person A, several times, to have sexual intercourse with him, while he “kept his gun next to bed each time”. This allegedly was happening in the period from November 1992 to March 1993.
 
As the hearing continued the Prosecution presented a few pieces of additional evidence, most of which referred to the indictee’s military engagement and his status as a war disabled person.
 
Prosecutor Vesna Budimir presented, as evidence, an analysis on the suffering of Serbian people in the Konjic area, made, in 2001, by the Republika Srpska Intelligence and Security Service. 
 
“The analysis proves that a detention camp was formed in Donje selo and that the movement of the Serbs, living in it, was limited,” Budimir said.
 
The State Prosecution presented, as additional evidence, an interview with indictee Pincic, published by “Nas glas”, which was the official newspaper of the Croatian Community of Herceg-Bosna, in 1995. In the mentioned text “indictee Pincic’s military engagement and status” were confirmed.
 
The Prosecution also presented, as material evidence, a note on the arrest of the indictee and the search of his family house, as well as the photographs of his property.
 
Concerning all pieces of Prosecution’s evidence, the Defence disputed the authenticity, lawfulness and relevance to the proceedings.
 
The trial is due to continue on November 4.
