Meddzida Kreso, President of the Court of Bosnia and Herzegovina, says that, from the very beginning the Court has advocated for treating war-crimes and organised crimes cases as public interest cases, but the Agency for Protection of Personal Data of Bosnia and Herzegovina insisted on an opposite stand.


21. March 2013.
Petar Kovacevic, the Director of the Agency for the Protection of Personal Data of Bosnia and Herzegovina, considers that the anonymisation of war crimes cases is not in accordance with the opinion which the Agency submitted to the state judicial institutions in early 2012.

“In July 1995, in his position as a President of Republika and a supreme commander of the army and police, and as part of the organized criminal enterprise together with S.M and others in their positions as commanders and chief officers of the army and police of Republic, the accused R.K. incited, ordered and executed acts of genocide in municipality S., resulting in the death of approximately 8,000 people: E.K., A.B, etc.“

Representatives of judicial institutions from Bijeljina and Tuzla, the region’s media as well as representatives of non-governmental organizations request amendments to Bosnia and Herzegovina’s Law on Protection of Personal Data, by which the data on indictments and verdicts will be made anonymous.

War crimes trials are not private disputes that should be protected from the public, but processes that should be used for determining what happened and why, as well as who is responsible – says Mirko Klarin, Director of the SENSE Agency, which follows trials held before The Hague Tribunal.

The Court of Bosnia and Herzegovina has issued a “Rulebook on Gaining Access to Information under the Control of the Court and the Cooperation with the Community”, by which the media can get video or audio recordings to the duration of 10 minutes from the trials, which means that testimonies of victims and witnesses will no longer be possible to be heard by the electronic media.
