New Sentence Pending in Ljubisa Vranjes Appeal

The hearing was held before the state court’s appeals chamber after the Constitutional Court of Bosnia and Herzegovina repealed the verdict due to the incorrect application of law. The provisions foreseen by the laws of the former Yugoslavia should have been applied.
Trial chamber chair Mirko Bozovic said the portion of the verdict containing determined facts had not been repealed.
State prosecutor Dzevat Muratbegovic said the prosecution had received the Constitutional Court’s decision, but stuck to the revised indictment.
Nenad Balaban, Vranjes’ defense attorney, failed to appear at today’s hearing. He informed the state court that he had to attend another hearing in Banja Luka.
In April 2012, the appeals chamber of the state court sentenced Ljubisa Vranjes, a former member of the public safety center in Banja Luka, to eight years in prison for committing crimes in Kotor-Varos in 1992.
He was found guilty according to the Criminal Code of Bosnia and Herzegovina. The defense filed an appeal with the Constitutional Court of Bosnia and Herzegovina, which determined that the retroactive application of law was to Vranjes’ detriment and partially repealed the verdict.
The appeals chamber of the state court will render its decision at a later stage.
