Subotic is charged with having committed war crimes in Dusina, Zenica municipality during the armed conflict between the Army of Bosnia and Herzegovina, ABiH, and Croatian Defence Council, HVO, on January 26, 1993.

According to the charges, the former member of the Second Battalion with the Seventh Muslim Brigade of the Army of Bosnia and Herzegovina, ABiH, who was accompanied by other members of his Battalion, intruded Dusina village, surrounded houses owned by Croat civilians and gave an order to capture about 40 civilians and several disarmed HVO soldiers.
 
It is further alleged that, acting in collaboration with other soldiers, he separated eight Croat civilians from the others, escorted them to one of the houses and ordered members of the Company to kill the civilians, one by one. 

The indictment, which was confirmed on June 24, alleges that the indictee singled out one civilian from the group. One of the Company members then opened a burst of fire from an automatic gun at him, making him fall down to the ground. As the man was still showing signs of life, Subotic ordered that another burst of bullets be fired at him.

The indictee then singled out another civilian and began physically abusing him, by hitting him on his head with his fist and on his stomach and legs with his legs. He then approached a third civilian, began questioning him and ordered him to walk in front of him towards a house. While the man was walking, he opened burst fire from an automatic gun on his back, killing the man. 

According to the charges, Subotic approached the group of civilians and disarmed HVO soldiers, who had been separated from others, and, acting in collaboration with other unit members, deprived four civilians of their lives before giving an order to stop the killing.
