The trial of Vinko Kondic, Bosko Lukic and Marko Adamovic for crimes committed in Kljuc area will be postponed until the first indictee’s health state has been determined. He suffers from Parkinson’s disease.
“In the latest findings dated June 23 a team of experts determined that the indictee’s health has deteriorated and proposed that he be referred to a medical institution for a two-month course of neurological treatment and physical rehabilitation,” Trial Chamber Chairwoman Jasmina Kosovic said.
In their earlier findings the team of experts determined that Kondic was capable of following the trial, but he has failed to appear at more than ten hearings, saying he was not feeling well.
Kondic, Lukic and Adamovic are charged with persecution, murder, extermination, deportation, torture, forcible disappearances and other crimes committed against Bosniaks and Bosnian Croats from the Kljuc area in 1992.
The indictment states that Kondic was Chief of the Public Safety Station in Kljuc, and Lukic was Commander of the Territorial Defence, TD, Headquarters, while Adamovic was Commander of Kljuc Town Defence Command and Deputy Commander of the Kljuc TD Battalion.
“We shall do all we can to refer the indictee to an institution which can provide him with the therapy proposed by the court experts. As far as the continuation of this trial is concerned, the Court will decide whether to separate the cases or discontinue the trial,” Kosovic said.
The Prosecution of Bosnia and Herzegovina asked the Court to postpone the trial of the three indictees for two months, until the indictee has completed his rehabilitation, and then have a team of court experts prepare new findings and assess whether Kondic is capable of following the trial.
The indictees’ Defence attorneys did not object to the proposal, but the Defence of the first indictee said it advocated separation of the cases.
“The Defence confirms the proposal it made at the beginning of the year, asking the Court to separate the cases. We know the disease is progressive and that no significant improvement can be expected,” Kondic’s Defence attorney, Predrag Radulovic, said.
The trial of Kondic, Lukic and Adamovic began in September 2008.
