Trbic: Court expert to present findings on October 20

Trial Chamber Chairman Davorin Jukic explained that the findings of Petar Vuga, legal expert, invited by Milorad Trbic’s Defence, had already been “included in the file” but the findings would be presented on October 20, 2008.
Vuga’s findings refer to the Republika Srpska Army structures in the period of time covered by the indictment.
The State Prosecution charges Trbic, former assistant commander for security with the Zvornik Brigade of the Republika Srpska Army, VRS, with genocide and participating in the forcible resettlement and execution of Bosniaks from Srebrenica.
The Defence’s proposal, asking the Court to cover the costs arising from Vuga’s expertise, because “the indictee is not able to cover the costs”, was discussed at this hearing.
“Milorad Trbic has been under custody for five or six years already. He therefore does not have any income. He cannot sell real estate because he does not personally own any,” said Milan Trbojevic, Defence attorney of Trbic.
The Trial Chamber mentioned that court expert Vuga asked for a fee amounting to “about 3,000 euros”. It said that the Court would agree to “pay the expertise costs in advance”, only after indictee Trbic provided evidence, proving that he could not pay for it himself.
“The Court shall ask court expert Vuga to submit a specification of his costs in order to justify the requested fee. Only after this has been done, the Court shall determine the amount to be paid,” Jukic said.
