Bosiljko and Ostoja Markovic Request Repeal of Rape Verdict

The defense of Bosiljko and Ostoja Markovic asked the appeals chamber of the state court to repeal the verdict against them. The defendants were both sentenced to ten years in prison for the wartime rape of a 14 year old girl in Kotor-Varos.

The state prosecution called upon the court to reject the defense’s appeal as unfounded and to confirm the first instance verdict handed down by the state court.

“If the court accepts that my client committed this crime, I think the sentence is too long in comparison to other sentences and the criminal policy for such crime,” said Nebojsa Pantic, Bosiljko Markovic’s defense attorney.

Ostoja Markovic’s defense asked the court to repeal the first instance verdict and order a retrial before the appeals chamber of the state court.

Prosecutor Olivera Djuric said the appeals were unfounded and proposed that the court confirm the first instance verdict.

In June 2015, the defendants, both former members of the Kotorvaroska Brigade of the Bosnian Serb Army, were found guilty of alternately raping injured party S-4 several times on June 28, 1992. They also were found guilty of forcing her to perform oral sex on them after raping her.

Under the verdict, the Markovics have a shared obligation to pay 26,500 BAM to the injured party as compensation for the violation of her freedom and personal rights as well as her mental suffering.

The appeals chamber will render a decision at a later stage.
