Djojic, a former member of the 102nd Brigade of the Croatian Defense Council, has been charged with the rape, sexual abuse and humiliation of a woman in Odzak in July 1992. Djojic and the other perpetrators allegedly told the injured party that if she resisted her six-month old son would be killed.

Kucukalic presented his findings and those of a team of experts on Djojic’s mental health. He said Djojic could participate in the trial if precise questions were posed to him and if he was given sufficient time to answer.

“The examinations should not last more than 45 minutes. I propose they be followed by a 30 minute break,” Kucukalic said.

Kucukalic determined that Djojic wasn’t completely willing to communicate with him or the other experts.

“We couldn’t determine to what extent this was caused by brain damage, and to what extent it was a result of his will, his deliberate intention,” Kucukalic said.

In March 2015, Muhamed Ahmic, an expert witness for the defense, said Djojic was incapable of participating in the criminal proceedings.

The next hearing will be held on September 11, when Kucukalic and Ahmic will face each other in the courtroom.
