Fundup, a former member of the Focanska Brigade of the Bosnian Serb Army, has been charged with the murder and abuse of Bosniak civilians in Foca in June 1992.The indictment alleges that he participated in the murder of two children and five persons, as well as the wounding of one woman, in Cohodar Mahala. In this instance, Fundup allegedly acted in collaboration with two other persons.

Fundup is also charged with having abused three civilians, including two children. It is further alleged that he lined up civilians in Gornje Polje and cocked his rifle at them, to convince them that they would be shot. In this instance, Fundup allegedly acted in collaboration with one other person.

In his introductory statement, prosecutor Adis Nuspahic said that he would prove the allegations contained in the indictment by examining witnesses and presenting material evidence.

Defense attorney Slavisa Prodanovic said he would prove “where Fundup was, when the crimes were committed, as well as where the two idiots who committed the crime were.”

Defense attorney Slavisa Prodanovic said he had already taken a statement from a witness, who he said “cannot stand seeing an innocent man in prison.”

Fundup also addressed the court.

“The way I was raised does not allow me to commit such crimes. I shall prove that at this trial,” he said.

The first prosecution witnesses will be examined on March 20.
