The warrant against Djukic was issued at a request of the Court of Bosnia and Herzegovina, BiH. Djukic has the citizenship of Serbia.

Djukic, who was sentenced to 20 years in prison, does not intend to return to BiH in order to serve his sentence, BIRN was previously told by Dusko Tomic, one of his Defence attorneys.

He can serve his sentence in Serbia, which signed an agreement with BiH in 2010, according to which persons, who are sentenced under second instance verdicts, are prevented from avoiding serving their sentences.

“Once the convict has been located, further measures for execution of imprisonment sentence will be undertaken. These include a possibility of sending a request to the judicial bodies of the Republic of Serbia to take over the execution of the imprisonment sentence,” the Court of BiH announced earlier.

Djukic, a former Commander of “Ozren” Tactical Group with the Republika Srpska Army, VRS, was sentenced for having ordered an artillery squad to shell Tuzla town with cannons on May 25, 1995.

Several artillery projectiles hit the downtown area known as Kapija and killed 71 people.

He was released from prison at the beginning of this year, because the verdict, under which he was sentenced to 25 years in prison according to the Criminal Code of BiH, was quashed due to the wrong application of the laws.

After that the Court of BiH applied the law that was more favourable for the indictee, i.e. the Criminal Code of the former Yugoslavia, and reduced his sentence by five years.
