In its announcement the Court said that the suspects were ordered into custody due to a danger that they might flee and influence witnesses and accomplices, as well as due to a possibility of destruction or hiding of evidence.
 
“The Court has ordered the suspects into custody due to a grounded fear that, if released to liberty, they might destroy, hide, change or forge evidence or traces which are important for the proceeding, and interfere with the proceedings by influencing witnesses, accomplices or concealers of the crime. The custody against suspects Marijan Brnjic, Pavo Glavas and Ilija Glavas has also been ordered due to the existence of circumstances, indicating that there is a danger that they might attempt to flee,” the Court announced.
 
On April 22 this year the State Prosecution requested that the suspects be ordered into custody, because they had dual citizenship and the fact that three of them lived in other countries.  
 
The Defence teams objected to the custody motion, saying that it was sufficient to order prohibiting measures, including a ban on leaving their places of residence, and confiscate their personal identification documents.
 
Brnjic, Pavo and Ilija Glavas and Barukcic, former members of the Croatian Defence Council, HVO, were arrested on April 20 and 21 due to a suspicion that they committed crimes, including the rape of several Serb women, in Odzak municipality, from June to August 1992.
