Kustura lives in Zagreb and has both Croatian and Bosnian citizenship. Because of his citizenship, he cannot be extradited to Bosnia to stand trial.

Kustura is charged with killing a member of the Bosnian Army on January 18, 1993 in Hrasnica, Gornji Vakuf. He is also charged with wounding a member of the Bosnian Army, at the same location.
