Prohibiting Measures Proposed for Kladanj Suspects

In asserting that the proposal by the Prosecution is not grounded, the defence teams for the accused challenged the proposed prohibiting measures.

The BiH Court will subsequently adjudicate.

Prosecutor Dragan Corlija moved the BiH Court to prohibit the accused from leaving the place of residence and oblige them to report to police station on a weekly basis.

Corlija proposed that the accused should have their passports seized and prohibited from receiving new ones, and that any contact with the injured parties and accomplices should be prohibited.

“The accused persons are aware of the gravity of the criminal offences, including the fact that the minimum sentence carries a term of ten years which could cause them to leave the place of residence,” Corlija stated.

For crimes in Stupari (Kladanj Municipality), the Prosecution has charged Safet Mujcinovic, Selman Busnov, Nusret Muhic, Zijad Hamzic, Ramiz Halilovic, Nedzad Hodzic, Hariz Habibovic and Osman Gogic.

They are charged with having participated in the illegal detention, inhumane treatment, beating up, and causing of serious bodily injury to Stupari civilians from May 1992 to mid-June 1993.

Defence teams for the accused asserted that the proposed prohibiting measures are unfounded taking into consideration that it is in the interest of the accused to close the case as soon as possible, noting that they have no intention of leaving their place of residence or influencing witnesses.

“The events took place 20 years ago, the investigation was initiated eight years ago, whereas it has been ten years since the ICTY took the case file,” stated Fahrija Karkin, defence counsel for the accused Osman Gogic.

Karkin proposed that the case against the accused be deferred to Tuzla Cantonal Court.
